These Terms & Conditions govern use of the Hey Miami website and direct booking services operated by Hey Miami LLC. By accessing the website or making a direct reservation, you agree to these Terms & Conditions and, when applicable, the Booking Policies and property-specific terms.
Hey Miami works to keep property descriptions, photographs, rates, availability, amenities, and other website information accurate. Minor changes may occur, and information may be updated without notice. Availability and pricing are not guaranteed until a reservation is confirmed.
Photographs and descriptions are intended to represent the property reasonably but may not reflect temporary changes, maintenance, replacement furnishings, weather, surrounding construction, or other conditions outside Hey Miami’s reasonable control.
Hey Miami uses third-party technology and service providers to operate its website and reservation services. Reservation information may be processed through Guesty, and payment transactions may be processed through Stripe. Other providers may support website hosting, analytics, communications, customer relationship management, fraud prevention, and advertising.
Use of third-party services may also be subject to those providers’ terms and privacy practices.
By providing a payment method, you represent that you are authorized to use it and authorize the processing of charges that you approve during booking and other amounts properly due under the reservation, including authorized damage or rule-violation charges as described in the Booking Policies.
Where a security authorization is used, the authorization itself is not a completed charge. Card issuers may temporarily reduce available credit or funds while the authorization is active.
The Hey Miami name, branding, website design, original text, graphics, and other content owned by Hey Miami are protected by applicable intellectual-property laws. You may use the website for personal, non-commercial purposes related to evaluating or booking accommodations. You may not copy, republish, scrape, sell, or commercially exploit protected website content without permission, except as permitted by law.
You may not misuse the website, attempt unauthorized access, interfere with website operation, introduce malicious code, submit fraudulent reservation information, impersonate another person, or use the website for unlawful purposes.
Hey Miami does not guarantee uninterrupted or error-free website operation. Website, payment, booking, communications, internet, building systems, utilities, or third-party services may occasionally be unavailable. Hey Miami may suspend or modify website functionality for maintenance, security, operational, or legal reasons.
To the fullest extent permitted by applicable law, the website and website content are provided on an “as available” basis. Hey Miami does not disclaim obligations that cannot legally be disclaimed.
To the fullest extent permitted by applicable law, Hey Miami will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from use of, or inability to use, the website. Nothing in these Terms limits liability where such limitation is prohibited by law.
Separate rights and obligations arising from an accommodation stay are governed by the Booking Policies, applicable property terms, and applicable law.
To the extent permitted by law, you agree to be responsible for claims, losses, or costs resulting from your unlawful use of the website, your material breach of these Terms, or your violation of another person’s rights. This provision does not require you to indemnify Hey Miami for Hey Miami’s own unlawful conduct.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where another law must apply. Any dispute will be handled in a court or forum having lawful jurisdiction over the matter.
Hey Miami may update these Terms from time to time. The current version will be posted on the website with an updated effective date. Terms applicable to a confirmed reservation will not be retroactively changed in a way that materially reduces a guest’s contractual rights unless permitted by law or agreed by the parties.
